Abstract

Al-Aqtāb al-Fiqhiya alā Mazhab al-Imami is one of the precious works of Shaykh Muhammad bin Zeinoddin, known as Ibn Abi Jumhoor Ehsā’ie, who was a famous scholar in 9th century. This book is not limited to jurisprudential rules, but some Arabic rules and Usul rules are also discussed there. The author of the book not only talks about Imami scholars’ ideas and opinions, but also deals with Sunni scholars’ opinions and jurisprudential branches under the titles “fihe Qawlayn” and “fihe Ihtimālān”. This article intends to examine and introduce the mentioned book. Regarding this, the writer is going to start his paper by providing a definition and illustrating the importance of the knowledge and history of jurisprudential rules. Following this, he mentions the verses and traditions which are the basis of jurisprudential rules; and outlines the major difference between jurisprudential and Usul Rules. Then, having introduced Sunni and Shiite writers of rules, he introduces the author of Al-Aqtāb al-Fiqhiya. Other issues raised in this paper include Ibn Abi Jumhoor Ehsā’ie’s education and teachers, the position of Al-Aqtāb al-Fiqhiyaamong other works, the most important jurisprudential rules in this book, the effect of Shaykh Shams al-Din Muhammad bin Makki (First Martyr)’s Qavā’ed wa al-Favāed on this book, and the explanation of some of Ehsā’ie’s unique judgements. After that, the writer talks about the printed version of Al-Aqtāb al-Fiqhiya, corrected by Shaikh Muhammad Hasun, and points out its conceptual and typographical errors. Finally, talking about the book manuscripts, he explains about the characteristics of his own research about and correction of the book
